¶1Heard Sri Shobhit Saxena, learned counsel for petitioner and Sri Satendra Bhushan Dubey, learned Standing counsel for State respondents.

¶2Present petition has been filed seeking following reliefs: "I. Issue a writ order or direction in the nature of mandamus directing the respondent no. 2 to 4 to take necessary action against the respondent no. 6 who is raising construction and encroaching the Gaon Sabha land of gata no. 661, 659, 701 and 739 and direct to demolished the construction raised by respondent no. 6 on the said disputed Gaon Sabha land."

¶3At the very outset, Sri Satendra Bhushan Dubey, learned Standing counsel for State respondents came up with specific instructions which is taken on record through which it has been apprised that no as such encroachment has been carried out by any of the respondents who has been alleged in the instant petition.

¶4In view of the aforementioned facts and circumstances, no cause of action further survives for petitioner to pursue the instant petition and the same stands disposed of accordingly. Order Date :- 28.11.2023 Shaswat High Court of Judicature at Allahabad
