¶1The case of the petitioner is that plot no. 690 measuring 40 square meters in Dev Prayagam Housing Scheme was allotted to him vide allotment letter dated

21.8.2002. However, its possession has not been handed over to the petitioner so far because of some pending litigation with another person. The petitioner has therefore, prayed for a direction to the respondents to allot some other plot to the petitioner and consider his application filed in this behalf dated 25.9.2023.

¶2Sri Ram Raj Singh, learned counsel appearing on behalf of respondent nos. 2 and 3 does not dispute that the aforesaid plot was allotted to the petitioner. He submits that the petitioner can take back his money.

¶3Learned counsel for the petitioner is not agreeable to the offer and submits that the respondents should consider his application for allotment of alternate plot.

¶4Accordingly, the petition is disposed of with direction to the respondents-Prayagraj Development Authority to pass speaking order on the application of the petitioner dated 25.9.2023 within six weeks from the date of communication of the instant order along with photocopy of the representation/application.
