And 5 Others Counsel for Petitioner :- Sachin Kumar Sharma Counsel for Respondent :- C.S.C.,Om Krishna Yadav,Ram Krishna Koli Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J. Re; Impleadment Application No.2 of 2023

¶1Heard.

¶2Impleadment Application is allowed.

¶3Let the necessary impleadment may be carried out in the array of parties during the course of the day.. Re; Writ Petition

¶4The present writ petition has been preferred on the ground that the private respondent, who had preferred Writ-C No.33285 of 2015 (Shyam Babu @ Shyam Lal and another vs. State of U.P. and 5 others) in which the petitioner is also a party has been dismissed for non-prosecution.

¶5In this backdrop, we have entertained the instant writ petition and asked the concerned District Magistrate to file response. Today, when the matter is taken up, Sri Ram Krishna Koli, Advocate, who preferred Writ-C No.33285 of 2015 submits that the said writ petition has been restored and the pleadings have already been exchanged.

¶6Considering the facts and circumstances, once we have declined to entertain the instant writ petition at this stage, learned counsel for the petitioner states that he is not inclined to press this writ petition and the same may be disposed of as not pressed leaving it open to the petitioner to press the relief before the appropriate forum/Court.

¶7With the aforesaid leave, the writ petition stands disposed of.

¶8The objection filed by the petitioner is taken on record. Order Date :- 30.11.2023 S.P. High Court of Judicature at Allahabad
