¶1After some arguments, learned counsel for the petitioners has confined his prayer only to the effect to direct the court below to decide the O.S. No. 33 of 2015 expeditiously.

¶2In view of the order proposed to be passed herein, no useful purpose would be served by putting the opposite party to notice and keeping this petition pending before this Court. However, in case the opposite party feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved.

¶3The matter is pending before the Court below since 2015 and considerable time has already been lapsed but till date no final decision has been taken in the matter.

¶4In this view of the matter, without interfering with the order dated 11.8.2023 passed by Additional Session Judge/Special Judge (E.C. Act) prayagraj in Civil Revision No. 57 of 2022 (Rajwanti Devi and Others vs. Munna Yadav and another) and order dated 8.4.2022 passed by Additional Civil Judge (J.D.) Court No. 5, Prayagraj in O.S. No.33 of 2015, which are under challenged, the present petition is disposed of directing the court below to decide the aforesaid suit expeditiously strictly in accordance with law and without granting unnecessary adjournment unless there is no legal impediment.
