¶1Instruction placed today are taken on record.

¶2Heard Sri Bharat Bhushan Paul, learned Senior Advocate assisted by Sri Saurabh Paul, learned counsel for the petitioner and Sri Amit Manohar, learned Additional Chief Standing Counsel for respondent nos.1 to 4.

¶3As per instructions the claim of the petitioner regarding promotion has been accorded due consideration and sealed cover procedure has been adopted on account of criminal trial going on in connection with case crime no.817 of 1993 under Section 147, 336, 436, 34, 427, 149 IPC and Section 3/4 of Prevention of Damage to Public Property Act, 1984.

¶4Learned Additional Chief Standing Counsel has argued that the compliance of the requirements as contained under Paragraph 10 of the Government Order dated 28.05.1997 has to be there while opening the sealed cover.

¶5Be that as it may, since the trial is already going on and there is a Government Order and more than an year has passed, it will be appropriate for the respondent to dispose of the pending claim of the petitioner for opening the sealed cover regarding his promotion on the post of Sub Inspector in the selection year 2021 in the light of the provisions as contained under Paragraph No.10 of the Government Order which is reproduced hereunder: "(10)

¶6In the event petitioner is found eligible for promotion after the completion of the requisite formalities, the same shall be accorded to him may be provisionally to abide by the outcome of the trial pending of criminal case.

¶7Appropriate decision shall be taken within a period of two months of production of certified copy of this order.
