¶1Heard Sri Vinit Mishra, learned counsel for the petitioner and Sri R.P. Tiwari, learned Standing Counsel appearing for all the respondents.

¶2The petitioner's request for correcting the date of birth in the high school certificate cum mark-sheet of 2018 is pending consideration before the Respondent No.3, Regional Secretary, Madhyamik Shiksha Parishad, Uttar pradesh, Regional Office, Bareilly.

¶3It is contended that though the application was forwarded by the Principal within time and certain reports have come into existence, no decision has been taken till today.

¶4Sri Tiwari, learned Standing Counsel submits that such a request has to be considered strictly in accordance with law, particularly, Chapter-3 Regulation-7 framed under U.P. Intermediate Education Act, 1921 and subject to the satisfaction of the authorities in relation to all the aspects.

¶5Considering the facts and circumstances of the case and without expressing any opinion on the merits of the petitioner's request for correction, the writ petition stands disposed of directing Respondent No.3, Regional Secretary, Madhyamik Shiksha Parishad, Uttar pradesh, Regional Office, Bareilly to verify the petitioner's claim and documents by the end of January, 2024 and submit the report before respondent No.2 before 15.2.2024, provided a certified copy of this order is produced before the Respondents No.3 along with a fresh application by the petitioner within a period of three weeks from today.

¶6The respondent No.2, Secretary, Madhyamik Shiksha Parishad, Uttar Pradesh, Prayagraj shall thereafter take a decision in the matter in accordance with law before 31.3.2024.

¶7During the course of taking decision, the Respondents No. 2 and 3 shall also call for requisite report from the Principal of Holy Convent Higher Secondary School, Madhuvan Colony, Budaun. Order Date :- 30.11.2023 Kumar Manish. High Court of Judicature at Allahabad
