Sri Amit Saxena, learned senior counsel assisted by Sri Siddharth Singhal, learned counsel for the respondent raises a preliminary objection to the maintainability of the present writ petition and submits that in the array of parties there is no person, named Vikash as stated in paragraph 1 of the affidavit accompanying the writ petition, which is contrary. Confronted with the said facts learned counsel for the petitioner prays to withdraw the present writ petition with liberty to file a fresh writ petition. The writ petition is accordingly dismissed as withdrawn as prayed. In case the petitioner files a fresh writ petition a copy of which shall be served upon Sri Siddharth Singhal, learned counsel for the caveator.
