1.Heard learned counsel for the petitioner and Mr. Sanjay Kumar Srivastava, learned State Law Officer for State-respondents.

2.The instant writ petition has been filed praying for a mandamus directing respondent No.2/Sub Divisional officer,Tehsil-Sadar, District-Mau to decide suit No.8270 of 2021 computerized Case No. T202115510108270 'Murtaza Khan Vs.Raju and others' under Section 144 of U.P. Revenue code, 2006 within stipulated period.

¶3Learned counsel for the petitioner submitted that in spite of the interim direction issued by this court, suit under Section 144 of U.P. Revenue Code, 2006 filed in the year 2021 has not been decided.

4.In compliance of the interim direction issued by this court, respondent no.2 sent the instruction dated 15.3.2023 that proceeding shall be concluded expeditiously but till date proceeding has not been concluded as stated by learned counsel for the petitioner.

¶5Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to respondent No.2/ Sub Divisional officer,Tehsil-Sadar, District-Mau to consider and decide the aforementioned suit in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
