Court No. - 68 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 50113 of 2023 Applicant :- Jeetu Sharma @ Jitan Opposite Party :- State of U.P. Counsel for Applicant :- J.B. Singh Counsel for Opposite Party :- G.A. Hon'ble Dr. Gautam Chowdhary,J.

¶1Heard learned counsel for the applicant, learned A.G.A for the State, Sri Surendra Kumar Tripathi, learned counsel for the informant and perused the record.

¶2The prosecution story in brief is that informant's son namely, Ankit Batra was admitted in de-addiction Centre namely, Aviska Foundation Tronica City and on 15.03.2023 some hot talk took place between the informant's son and Vipin Thakur, the owner of the said foundation, in the morning of 15.03.2023, said Vipin Thakur intimated his daughter-in-law that Ankit is not well and some treatment is required to be given and had stated that he will treat him permanently. Thereafter the accused Vipin Thakur along with associates had beaten him due to which he denied.

¶3Learned counsel for the applicant submits that the applicant is not named in the F.I.R. and his name surfaced in the confessional statement of the co-accused persons namely, Vipin Kumar and Megh Singh. He further submitted that there is no direct evidence against the applicant and that the applicant has been roped due to village party bandi. He further submits that there is nothing on record to demonstrate the complicity of the applicant in commission of alleged offence except the confessional statement of the co-accused persons. Learned counsel has next argued that the main role has been assigned to the co-accused Vipin Kumar and that the role of the applicant is distinguishable from the case of the co-accused Vipin Kumar. No motive has been assigned to the applicant in commission of alleged offence. It is thus contended that the applicant is entitled for bail. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him. He next submits that applicant is languishing in jail since 23.05.2023, having no criminal history.

¶4Per contra, learned A.G.A. has opposed the prayer for bail of the applicant by contending that the innocence of the applicant cannot be adjudged at pre trial stage, therefore, he does not deserve any indulgence.

¶5After perusing the record in the light of the submissions made at the bar and after taking an overall view of all the facts and circumstances of this case, the nature of evidence and also the absence of any convincing material to indicate the possibility of tampering with the evidence, without expressing any opinion on merits of the case, this Court is of the view, that the applicant may be enlarged on bail.
