Judgment
Court No. - 34 Case :- WRIT - A No. - 19853 of 2023 Petitioner :- Rajendra Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Udai Bhanu Singh Counsel for Respondent :- CSC Hon'ble Ajit Kumar,J. Petitioner has rushed to the Court for enforcement of the labour court award. It transpires that on application being moved, recovery certificate has already been issued by Tehsil to enforce the award. I do not find any justification to interfere in the matter in exercise of power under Article 226 of the Constitution when full-fledged procedure is prescribed for under the the Special Law for enforcement of award of labour court. However, I may observe that labour court would ensure that its award is executed within a stipulated period of time. Appropriate measure shall be taken, either attachment of property or any other coercive measure as may be permissible law. It is expected that appropriate decision shall be taken within a period of three months from the date of production of certified copy of this order. With the aforesaid observation and direction, this petition stands disposed of. Order Date :- 30.11.2023 Sanjeev High Court of Judicature at Allahabad
