Judgment
Court No. - 34 Case :- WRIT - A No. - 19852 of 2023 Petitioner :- Harish Kumar Pathak Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Ramanuj Tripathi,Ashwani Tripathi Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. The petitioner wants consideration of representation dated 11th May, 2021. It transpires from the pleadings raised in the writ petition and documents brought on record, petitioner was working as Seasonal Collection Amin on temporary basis and was discharged from duty in the year 2010 and petitioner awaited for pretty long 11 years before making representation in the year 2021, then again awaited for another three years to approach this Court. Learned Standing Counsel submits that petition is liable to be dismissed on the ground of delay and laches. Admittedly petitioner was working as Seasonal Collection Amin on temporary basis and as such he has no right. He could have agitate the matter when he was discharged from duty. Having not approached the Court for pretty long 13 years, I do not find any justification to interfere in the matter at this stage. Petition is accordingly dismissed on the ground of delay and laches. Order Date :- 30.11.2023 Sanjeev High Court of Judicature at Allahabad
