By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for certain directions to the authorities for grant of full pension including other pensionary benefits. Learned counsel for the respondents Sri Anil Kumar Rai has raised preliminary objection regarding maintainability of this petition because the department in question stands notified under the Central Armed Forces Tribunal Act, 2007 and submits that the petitioner is an ex Army personnel and as such can avail such remedy before the Tribunal. I view of the above, I decline to interfere in the matter. However, liberty rests with the petitioner to apply before the Armed Forces Tribunal, if so advised.
