Judgment

Court No. - 3 Case :- WRIT - C No. - 27517 of 2023 Petitioner :- Naveel Ahmad Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Ved Prakash Pandey Counsel for Respondent :- C.S.C.,Brahmanand Singh,Satish Chaturvedi Hon'ble Siddhartha Varma,J. Hon'ble Shekhar B. Saraf,J.

¶1Heard learned counsel for the petitioner and Sri Brahmanand Singh, learned counsel appearing for the Bank.

¶2The petitioner had taken a loan of Rs. 2,28,000/- in the month of February, 2020. The petitioner through this writ petition has prayed that the loan be waived off on account of the fact that his business had failed due to COVID-19 pandemic.

¶3Learned counsel appearing for the Bank states that there is no provision for waiving off the loan. However, he submits that if the petitioner is ready to pay the amount he may do so in easy instalments.

¶4Under such circumstances, we provide that if the Bank gives the latest statement of account within a period of ten days to the petitioner then the petitioner shall within a period of one month pay off 25% of the loan and thereafter, he shall pay off the remaining loan amount in three equal monthly instalments. When the last instalment is to be paid then the Bank would inform the petitioner about the interest which might have accrued by that date. In the case of default, this order would stand automatically vacated.

¶5With these observations, the writ petition is accordingly, disposed of. Order Date :- 1.12.2023 M.S. Ansari (Shekhar B. Saraf, J.) (Siddhartha Varma, J.) High Court of Judicature at Allahabad
