¶1The petitioners have called in question an order dated

22.09.2023 passed by respondent no.3 i.e. Vice Chairman, Kanpur Development Authority, Kanpur cancelling the lease.

¶2Learned counsel for the petitioners concedes that against the impugned order, the petitioners have remedy of filing revision before the State Government under Section 41(3) of the U.P. Urban Planning and Development Act, 1973. He submits that the petitioners will file revision before the State Government, but prays that the delay in filing the revision may be condoned.

¶3Sri A.P. Paul, learned counsel appearing on behalf of K.D.A. and Sri Rajeev Gupta, learned Additional Chief Standing Counsel appearing for the State respondents have no objection to the same.

¶4Accordingly, the petitioners are relegated to the remedy of revision before the State Government. It is further provided that in case revision is filed within two weeks from today alongwith copy of the instant order, it will be entertained by the State Government and will be decided on merits within next six weeks.
