Shri Diwakar Tiwari, learned counsel for the applicant and Shri Umesh Chandra Verma, learned A.G.A for the State are present. The present transfer application has been filed to transfer the Session Trial No. 121 of 2017 (Satyaveer Versus Arjun Singh and Others) arising out of Complaint Case No. 1375 of 2015, under Sections 147, 148, 149, 452, 307 and 302 of I.P.C, Session Trial No. 122 of 2016 (State Versus Satyaveer Singh), arising out of Case Crime No. 262 of 2015, under Sections 307, 302, 120-B of I.P.C and Session Trial No. 444 of 2015 (State Versus Shaheeda) arising out of Case Crime No. 262 of 2015, under Sections 307, 302 and 120-B of I.P.C. pending in the court of Sessions Judge, Hathras, to any other competent court of adjoining district. Learned counsel for the applicant submits that the opposite party nos. 2 to 7 are very influential persons and due to this reason police did not file any charge sheet against them and under the pressure of opposite parties and the applicant is implicated in the murder of his mother and he has no hope for fair and impartial trial. Learned counsel for the applicant fairly admits that three other co-accused persons have not been made party in the present case and there is no allegation against the trial court. In view of the above the present transfer application has no merit and it deserves to be dismissed. Accordingly, the present transfer application is dismissed.
