Court No. - 39 Case :- WRIT - A No. - 19924 of 2023 Petitioner :- Anil Shankar Srivastava Respondent :- Union Of India And 4 Others Counsel for Petitioner :- Anil Kumar Srivastava Counsel for Respondent :- A.S.G.I. Hon'ble Saumitra Dayal Singh,J. Hon'ble Shiv Shanker Prasad,J.
¶1Having heard Shri Anil Kumar Srivastava, learned counsel for the petitioner and Smt. Manjari Singh, learned counsel for the respondents, no interference is warranted in the present proceedings inasmuch as the order impugned is an order passed by the Central Administrative Tribunal, Allahabad Bench, Allahabad refusing to exercise its contempt jurisdiction.
¶2Petitioner being an informant in the contempt proceedings before the Tribunal, refusal to entertain the contempt proceedings may not give rise to any challenge in judicial review.
¶3As to the further submission advanced by learned counsel for the petitioner that the order impugned in the present writ petition may cause prejudice to the petitioner in execution proceeding, suffice to observe that the order of the Tribunal may remain subject to final outcome of the writ petition filed by the Union to assail the main order of the Tribunal i.e. Writ-A 1487 of 2022 (Union of India and 2 others Vs. Anil Shankar Srivastava and 9 others).
¶4Accordingly, the writ petition is dismissed. Order Date :- 1.12.2023 SA (Shiv Shanker Prasad, J.) (S.D. Singh, J.) High Court of Judicature at Allahabad
