Court No. - 34 Case :- WRIT - A No. - 19900 of 2023 Petitioner :- Toshif Ali Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Anil Kumar Singh,Ajeet Mishra,Kishan Gautam Counsel for Respondent :- C.S.C Hon'ble Ajit Kumar,J.

¶1Heard learned counsel for the parties.

¶2By means of this petition filed under Article 226 of the Constitution of India, the petitioner has challenged the transfer order dated 19.05.2023.

¶3The ground for assailing the order is that petitioner's mother is seriously ill and she is being Type-2 diabetic person, she is more often hospitalised for the treatment purposes.

¶4Besides above it is argued that the petitioner's younger brother is also 90 per cent mentally retarded and therefore, he cannot take care of her mother.

¶5Learned Standing Counsel on the contrary submits that as per the medical documents brought on record, petitioner's mother is not getting any treatment at Gautambudh Nagar as she is under treatment at Meerut and petitioner if posted at Police Commissionerate, Agra can have no difficulty and so he can take care of her mother from there also.

¶6Be that as it may, it will be appropriate for the petitioner to first approach the authority in the matter. In the event petitioner approaches the Police Commissionerate, Agra by filing a representation raising all his grievances within a period of two weeks the same shall be looked into, considered and disposed of within the next two weeks' time.

¶7With the aforesaid observations and directions, this petition stands disposed of. Order Date :- 1.12.2023/Deepika High Court of Judicature at Allahabad
