The writ Court on 13.12.2021 while disposing off PIL No. 2266 of 2021 has passed the following order; "This writ petition has been filed for the removal of the encroachment from pond situate over plot no. 106 village Chhitauni, Post - Chauri Khurd, Tehsil - Bansi, District - Siddharth Nagar. Learned Standing Counsel submitted that if the petitioner is aggrieved by the encroachment over the Gaon Sabha land, he may take recourse to the filing of an application/case under Section 67 of the U.P. Revenue Code, 2006. Under such circumstances, without going into the merits of the case, it is being directed that if the petitioner files a case under Section 67 of the U.P. Revenue Code, 2006, within a period of 15 days from today, then the same shall, after hearing all the parties concerned, be decided within a period of 90 days thereafter, if there is no other legal impediment. With these observations, the writ petition is disposed of." Compliance affidavit has been filed on behalf of the State wherein it has been stated that proceedings under Section 67 of the U.P. Revenue Code, 2006 have been brought to its logical end on 11.11.2022, copy of which has been brought on record as annexure No. 1 to the compliance affidavit. As the order of writ Court has been complied by the opposite party, no case for contempt is made out. Contempt application stands dismissed. Contempt notice stands discharged. File consign to record.
