¶1Heard learned Counsel for the parties and perused the record.

¶2The present writ petition has been filed for the following relief. "(i) Issue a writ, order or direction in the mandamus commanding the respondent no.3, Assistant Collector/Tehsildar, Compierganj, District Gorakhpur to decide the preceding of Case No.2386 of 2021 (Gaon Sabha Vs. State of U.P.) under Section 67 of the U.P. Revenue Court within time fixed by this Hon'ble High Court without granting adjournment."

¶4A preliminary objection has been raised by learned Standing Counsel that the petitioner is complainant in the proceedings and he has no locus to file the present petition as he is not a party to the aforesaid proceedings, therefore, the present petition is not maintainable.

¶5In view of the above, the present writ petition is dismissed and as the proceedings are already pending before the respondent authorities, it is expected that the same may be decided in accordance with law after hearing all the parties concerned in accordance with law.
