Judgment
Court No. - 34 Case :- WRIT - A No. - 19937 of 2023 Petitioner :- Manoj Kumar Yadav Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Pavan Kumar Kushwaha Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J.
¶1Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
¶2Petitioner has challenged the transfer order dated 20.10.2023 whereby he has been transferred from tehsil-Sadar to tehsil-Meerganj within district-Bareilly on the ground that it is on account of utter harassment being meted out by respondent No.6 that petitioner has been made to transfer. He submits that even the first information report that has been lodged against petitioner is an outcome of revenge on account of brother of respondent No.6 being caught red handed taking bribe.
¶3It is argued on behalf of the petitioner that during past one year, various transfer orders have been passed transferring petitioner from one tehsil to another within district Bareilly and therefore, it appears, according to him, that it is nothing but an act to harass the petitioner.
¶4Upon a pointed query being made as to since when petitioner has been working in tehsil-Sadar, counsel for the petitioner is not in a position to give any satisfactory reply.
¶5Learned Standing Counsel submits that since petitioner has already made a representation before District Magistrate on
21.10.2023 that may be directed to be disposed of in accordance with law.
¶6In view of the above, since the petitioner has been transferred from one tehsil to another within same district, I decline to interfere in the matter. However, at the same time it is hereby provided that pending representation of the petitioner against the transfer order shall be disposed of by the District Magistrate by means of a reasoned and speaking order within two weeks from the date of production of certified copy of this order.
