This instant application under Section 482 Cr.P.C. has been preferred with a prayer to quash the charge sheet dated 12.12.2021, cognizance/ summoning order dated 01.07.2022 and proceeding of Case No. 959 of 2022 (State Vs. Javed and others) arising out of Case Crime No. 503 of 2021, under Sections 323, 506 I.P.C. and Section 3/4 of the Muslim Women (Protection of Rights on Marriage) Act, 2019, Police Station Seohara, District Bijnor, pending in the Court of Additional Civil Judge (S.D.)/ A.C.J.M., Court No.2, Bijnor. At the outset, learned counsel for the applicants submits that on account of some defect in the application, the applicant do not want to press this application, therefore, the same may be dismissed as withdrawn with liberty to file fresh application with better particulars. Learned A.G.A. for the State has no objection to such prayer. In view of the statement made by Shri Farid Ahmad, learned counsel for the applicants at the bar, the instant application is dismissed as not pressed with aforesaid liberty as prayed for. OfÏce is directed to return the certified copy of the documents to the learned counsel for applicants within a week after retaining xerox copy of the same to be kept on record as per law.
