This instant application under Section 482 Cr.P.C. has been preferred with a prayer to quash the charge sheet dated 05.06.2021, cognizance/ summoning order dated 15.10.2022 and proceeding of Sessions Trial No. 1191 of 2022 (State Vs. Ajay Mehra and others) arising out of Case Crime No. 68 of 2021, under Sections 8/21/29 NDPS Act, Police Station Govind Nagar, District Mathura, pending in the Court of learned Special Judge (NDPS Act)/ Additional Sessions Judge, Court No.7, Mathura. At the outset, learned counsel for the applicant submits that on account of some defect in the application, the applicant does not want to press this application, therefore, the same may be dismissed as withdrawn with liberty to file fresh application with better particulars. Learned A.G.A. for the State has no objection to such prayer. In view of the statement made by Shri Nipun Singh, learned counsel for the applicant at the bar, the instant application is dismissed as not pressed with aforesaid liberty as prayed for. OfÏce is directed to return the certified copy of the documents to the learned counsel for applicant within a week after retaining xerox copy of the same to be kept on record as per law.
