Judgment
Court No. - 40 Case :- WRIT - C No. - 39707 of 2023 Petitioner :- Chandra Bahadur Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Vikas Chandra Srivastava,Vipul Singh Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
¶1Heard Shri Vikas Chandra Srivastava, learned counsel for the petitioner and Shri S.C. Upadhyay, learned Standing Counsel for the State respondents.
¶2This writ petition has been filed for issuing a writ, order or direction in the nature of mandamus commanding the respondents to help the petitioner to restore his damage boundary as per law.
¶3Learned Standing Counsel has raised an objection that the present writ petition is not maintainable as for the same relief the petitioner had earlier filed a Writ C No.10182 of 2021 (Chandra Bahadur singh vs. State of UP and 4 others) and after some arguments, the same was dismissed as withdrawn on 21.6.2021 without any leave to file another writ petition. Therefore, the present writ petition is liable to be treated as second writ petition and the same is liable to be dismissed with exemplary cost.
¶4Confronted with this situation, learned counsel for the petitioner states that he is not inclined to press the present writ petition and the same may be dismissed as not pressed.
¶5Accordingly, the writ petition is dismissed as not pressed. Order Date :- 1.12.2023 RKP High Court of Judicature at Allahabad
