Judgment

Court No. - 44 Case :- MATTERS UNDER ARTICLE 227 No. - 11883 of 2023 Petitioner :- Vijay Bahadur And 2 Others Respondent :- Bechu Rajbhar Counsel for Petitioner :- Mainuddin Ahamad Hon'ble Ashutosh Srivastava,J.

¶1The amendment application has been filed for amending the prayer in the writ petition. The amendment is formal in nature and the same is allowed.

¶2Learned Counsel for the petitioners is permitted to carry out the amendment during the course of the day.

¶3The petitioners are defendants in a Suit, being Original Suit No.732 of 2019, which has been instituted for permanent injunction.

¶4The learned Civil Judge (Junior Division), Sadar, Mau, vide order dated 31.5.2019 has passed an order directing the parties to maintain status-quo regarding the disputed property. The defendants-petitioners have subsequently put in appearance in the proceedings and have filed their objections to the temporary injunction application and have sought its vacation. However, various dates have been fixed in the matter but their objections are not being considered nor the temporary injunction application is being decided.

¶5Having heard learned Counsel for the petitioners and having perused the record, this Court is of the opinion that this petition can be disposed off by requiring the Civil Judge (Junior Division), Sadar, Mau, seized with the interim injunction application filed in Original Suit No.732 of 2019 (Bechu Rajbhar Vs. Vijay Bahadur) to take up the same and pass appropriate orders considering the objections of the petitioners - defendants expeditiously, preferably within a period of 2 months, from the date of production of certified copy of order of this Court, strictly in accordance with law.
