Judgment
Court No. - 68 Case :- CRIMINAL MISC. BAIL CANCELLATION APPLICATION No. - 9592 of 2017 Applicant :- Madhu Jatav Opposite Party :- State of U.P. and Another Counsel for Applicant :- Sunil Kumar Shukla,Ghanshyam Das Mishra Counsel for Opposite Party :- G.A. Hon'ble Dr. Gautam Chowdhary,J.
¶1The instant bail cancellation application has been moved on behalf of the informant for cancelling the bail granted to the accused-opposite party nos.2 in Case Crime No. 378 of 2016 under Section 376 I.P.C., and Section 3 (2) (5) of SC/ST Act, Police Station Delhi Gate, District Aligarh.
¶2List revised. None appears to press this bail cancellation application on behalf of the applicant although the name of learned counsel for the applicant has been shown in the cause list.
¶3However, I have gone through the pleadings, grounds as also reliefs sought in the present bail cancellation application. Perusal of the record shows that the applicant was granted bail on
07.12.2016 whereas, the instant bail cancellation application was filed on 20.03.2017. More than six years have lapsed and it appears that the cause of action no more survives or the applicant has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, learned counsel for the applicant is not interested in the matter to be decided and that is why, counsel for applicant is absent.
¶4Accordingly, the instant bail cancellation application is dismissed as having become infructuous.
¶5Office is directed to communicate the order passed by this Court to the concerned Court below. Order Date :- 1.12.2023 Mustaqeem/S.Ali. High Court of Judicature at Allahabad
