¶1Heard Shri Deepak Kumar Tripathi, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.

¶2The petitioner has prayed for the following reliefs :- "(i) issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to take necessary action on the representation of the petitioner dated 23.06.2023 within stipulated time.

(ii) issue a writ, order or direction in the nature of mandamus commanding the respondent authorities to provide the police force for the construction of boundary wall of primary school situated in Village-Bhinkhinichak, Vikas Khand-Nathnagar, District-Sant Kabir Nagar."

¶3Learned counsel for the petitioner is confined his prayer that the grievance of the petitioner may be redressed as per law.

¶4Learned Standing Counsel very fairly submits that, in case, any such representation/application is pending, the same would be decided by the concerned authority.

¶5Considering the facts and circumstances, we are not inclined to keep the matter pending consideration.

¶6Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent of counsel for the parties, the writ petition stands disposed of directing the third respondent, Sub-Divisional Magistrate concerned to consider and decide the representation of the petitioner by passing a reasoned and speaking order in accordance with law expeditiously, preferably, within four weeks from the date of receipt of certified copy of this order.
