¶1Sri Vivek Kumar Singh, learned counsel has filed his power along with counter affidavit on behalf of the first informant today in the Court, is taken on record. Heard learned counsel for the applicant, learned A.G.A for the State, Sri Vivek Kumar Singh learned counsel for the first informant and perused the record.

¶2It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. Learned counsel further submits that the incident is alleged to have taken place on 11.08.2023 whereas, the F.I.R. has been lodged on 12.08.2023 without there being any plausible explanation of such an inordinate delay. He further submits that the medical report also shows that no spermatozoa seen and the X-Ray report also shows that the left elbow and and left wrist is fused, thus the victim is major. Learned counsel further argued that the medical report also does not corroborate with the prosecution version. He next submits that the matter is almost compromised between the parties, thus the applicant is entitled for bail. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him. He next submits that applicant is languishing in jail since 12.08.2023 having no criminal history.

¶3Per contra, learned A.G.A. has opposed the prayer for bail of the applicant by contending that the innocence of the applicant cannot be adjudged at pre trial stage, therefore, he does not deserve any indulgence. However, Sri Vivek Kumar Singh, learned counsel for the informant submits that the matter has been compromised between the parties and in this regard counter affidavit has also been filed.

¶4Considering the entire facts and circumstances of the case, submissions of learned counsel for the parties, nature of evidence, and all attending facts and circumstances of the case, the averments made in counter affidavit, without expressing any opinion on merits of the case, this Court is of the view that the applicant has made out a case for bail.
