Judgment
Court No. - 40 Case :- WRIT - C No. - 40267 of 2023 Petitioner :- Mr. Amar Kapoor Respondent :- Icici Bank Ltd. And 4 Others Counsel for Petitioner :- Bharat Kant,Kushal Kant Counsel for Respondent :- Manish Trivedi Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
¶1Heard Shri Bharat Kant, learned counsel for the petitioner and Shri Manish Trivedi, learned counsel for the ICICI Bank Ltd.
¶2Present writ petition has been preferred for a direction to respondents to dispose of the representation of the petitioner dated
26.9.2023; for a direction to quash the order dated 28.9.2023 passed by respondent no.1 and to release the petitioner from all personal guarantee/ liability towards respondent no.1.
¶3At the very outset, learned counsel for the respondent has raised an objection regarding the maintainability of the writ petition on the ground that a writ petition is not maintainable against private bank. In support of his submissions, he has placed reliance on the judgment in Federal Bank Ltd. v. Sagar Thomas & Ors., (2003) 10 SCC 733.
¶4Confronted with this, learned counsel for the petitioner fairly states that he is not inclined to press the present writ petition.
¶5In view of above, the writ petition is dismissed as not pressed. Order Date :- 1.12.2023 SP/ High Court of Judicature at Allahabad
