¶1Heard Shri Gambhir Singh, learned counsel for the petitioner and Ms. Subhra Singh, learned Standing Counsel for the State-respondents.

¶2The petitioner has prayed for the following reliefs :- "(i) issue a writ, order or direction in the nature of mandamus commanding the respondent nos. 2 to 4 to decide the representation of the petitioner dated

27.08.2023 within stipulated time.

(ii) issue a writ, order or direction in the nature of mandamus commanding the respondent nos. 4 & 5 not to interfere in peaceful running of business of the petitioner in respect of shop Gaurav Paint Store situated at Krishna Market Sharafa Chauk, Puranpur, District-Pilibhit."

¶3Learned counsel for the petitioner is confined his prayer that the grievance of the petitioner may be redressed as per law.

¶4Learned Standing Counsel raised an objection that the entire relief is against the private respondent, even though, criminal proceedings are also pending consideration, no reprieve can be extended under Article 226 of the Constitution of India.

¶5Confronted with this situation, learned counsel for the petitioner states that he is inclined to press the relief before the appropriate forum as he has already made the detailed representation before the respondent authorities and leave may be accorded to press the relief before the District Magistrate concerned.
