¶1Heard learned counsel appearing for the petitioner, learned Standing Counsel appearing for the Respondents No. 1 & 2 and Mr. Sanjay Kumar Singh, learned counsel appearing for the Respondent No. 3.
¶2Petitioner has filed this writ petition inter alia praying therein for the following reliefs :- I. Issue a writ, order or direction in the nature of mandamus/commanding the respondent no. 3 to get conclude inquiry against petitioner within stipulated period pursuant to order dated
05.11.2022. II. Issue a writ, order or direction in the nature of Mandamus directing/commanding the respondent no. 2 to re-instate the petitioner on the post of Head Master at Primary School Bhikhachhapra, Paschimi, Baria, District Ballia till pendency of enquiry pursuant to order dated 05.11.2022.
¶3Learned counsel appearing for the petitioner after arguing at some length has confined his prayer that since petitioner has already filed reply to the charge-sheet on 03.07.2023, therefore, a direction be issued to the respondents to conclude the disciplinary proceedings pending against the petitioner within a fixed time frame.
¶4Mr. Sanjay Kumar Singh, learned counsel appearing for the Respondent No. 3 does not have any objection if a direction is issued by this court for concluding disciplinary proceedings within a fixed time frame.
¶5In view of the aforesaid submissions advanced by the learned counsels appearing for the parties, this writ petition is finally disposed of with a direction to Respondent No. 3 to conclude the disciplinary proceedings pending against the petitioner within a period of three months from the date of presentation of certified copy of this order.
