¶1Heard learned counsel for the petitioner, Mr. Lal Babu, learned State Law Officer for the State-respondents.

¶2The instant writ petition has been filed praying for a mandamus directing respondent no. 2 / Additional District Magistrate (Judicial), District Kushinagar to decide the Case No. D-201805440001146 (Deep vs. Dukhi and others), under Section 30 of U.P. Revenue Code, 2006, within stipulated period.

¶3Learned counsel for the petitioner submitted that proceeding initiated on behalf of the petitioner under Section 30 of U.P. Revenue Code, 2006 is pending since 07.04.2018, even after expiry of more than five year.

¶4Considering the facts and circumstances of the case, the instant writ petition is finally disposed of with a direction to respondent no. 2 / Additional District Magistrate (Judicial), District Kushinagar to consider and decide the aforementioned case in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned.
