Judgment
Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 8722 of 2023 Applicant :- Mohammad Ahmad Opposite Party :- Alok Singh, District Basic Education Officer Counsel for Applicant :- Fasiha Fatma Hon'ble Rohit Ranjan Agarwal,J. The writ Court while deciding Writ-C No.62286 of 2009 along with connected Writ-C No.9831 of 2019, on 24.09.2019, had dismissed the Writ-C No.62286 of 2009 with cost. However, a liberty was given to the applicant, who was writ petitioner in Writ-C No.9831 of 2019, to approach this Court again, if necessity arises. Learned counsel appearing for the applicant submits that as the writ petition filed by the District Basic Education Officer has been dismissed, the payment of gratuity has not been made to the applicant. This Court finds that no order was passed in the writ petition filed by the applicant and only liberty was granted to the him to approach the Court again, if necessity arises. In view of the said fact, as no adjudication has been done by the writ Court on the writ petition filed by the applicant, no case for contempt is made out. Contempt application is misconceived and the same stands dismissed. However, it is open to the applicant to approach the writ Court for redressal of his grievance.
