¶1Heard learned counsel for the petitioner and learned Standing Counsel appearing for the defendant-respondents.

¶2It appears that an Original Suit No. 445 of 2019 was filed by the plaintiff-petitioner seeking a decree of permanent injunction regarding immovable property situate at plot no. 3 M., area 02420 hectares situated in Village Naranpur Bhanu, Pargana Bidhuna, District Auraiya. A written statement was filed and after hearing the parties, the application for temporary injunction 6C was allowed by the trial court by its order dated 23.12.2022. It is stated that despite a written statement having been filed by the defendant-respondents, the issues are yet to be framed.

¶3Under the circumstances and without entering into the merits of the matter, this petition is disposed of with a direction to the Civil Judge (Junior Division), Bidhuna, District Auraiya to proceed to frame the issues in case the defendants are duly served and written statement is on record. The matter shall be proceeded with without granting any unnecessary adjournment subject to availability of time and provided, there is no legal impediment. Order Date :- 2.12.2023 A. V.
