¶1Heard learned counsel appearing for the petitioner, learned Standing Counsel appearing for the Respondent No. 1 and Smt. Archana Singh, learned counsel appearing for the Respondents No. 2 & 3.

¶2Petitioner has filed this writ petition with a prayer that a direction be issued by this Court thereby commanding the respondents to post the petitioner in a school near to her home place on the basis of her critical family problems.

¶3Facts of the case, in brief, are that petitioner was working on the post of Assistant Teacher in District Siddharth Nagar. Petitioner applied for inter district transfer in the recent exercise of inter district transfers carried out by the respondents pursuant to the Government Order dated 2.6.2023. Petitioner has been transferred from District Siddharth Nagar to District Kannauj vide transfer order dated 26.6.2023. Petitioner, pursuant to her inter district transfer, has been allotted school in District Kannauj and there petitioner has also joined.

¶4Now the grievance of the petitioner is that since petitioner is having some family difficulties as petitioner's husband is 50% disabled and she has two children aged about 8 years and 2 years and further her father in law is also suffering from heart problem and his treatment is going on, therefore, she may be posted in the Block of her choice.

¶5I have heard learned counsels appearing for the parties and I find that the respondents have already entertained the application of the petitioner for inter district transfer and has transferred her from District Siddharth Nagar to District Kannauj. Now petitioner is claiming posting of her choice in a particular Block.

¶6This court is of the view that if employees are allowed to have choice of their posting in a particular Block and in a particular school, then it will be very difficult rather it will be impossible for the respondents to run the administration of the schools of the district.

¶7Petitioner has already been granted indulgence by the respondents and she has been transferred in the district of her choice, therefore, now the petitioner cannot be given liberty to choose the Block in the district of her transfer.

¶8In view of the aforesaid reasons, this writ petition lacks merit and is accordingly dismissed. Order Date :- 2.12.2023 Gaurav High Court of Judicature at Allahabad
