Heard learned counsel for the petitioners and learned Standing counsel for the State-respondents and Shri Vivek Kumar Rai, learned counsel for the respondent no.3. Learned counsel for the petitioners submits that the Central Government has launched a scheme i.e Agriculture Debit Waiver Scheme and Debt Relief Scheme, 2008, under which the application moved by the petitioner be considered. To the said submission, learned counsel for the respondent no.3 submits that the said scheme is not in operation till date. Confronted with the said fact, learned counsel for the petitioner comes up with a prayer that the application dated 16.10.2023 moved by the petitioner shall be considered in view of the current scheme i.e. "O.T.S.", which is in operation. To the said submission, learned counsel for the respondent no.3 has no objection. In view of the above, the petition is disposed of with direction to the respondent no.3 that if the petitioner moves a fresh application along with the certified copy of this order within a period of ten days from today, the same shall considered under the current scheme, which is in operation, and shall be decided within a period of one month from the date of filing of the said application.
