The present writ petition has been filed for mandamus directing respondent no. 2/ Prescribed Authority/ Sub Divisional Magistrate, Nichlaul, Maharajganj to decide Case No. 2948 of 2021 (Computerized Case No. T202105470202948) under Section 12 C of UP Panchayat Raj Act, 1947 (Paras Vs. Vinod and others) within a stipulated period as fixed by this Hon'ble Court. It has been stated by the learned counsel for the petitioner that case of the petitioner is pending since 2021 and same may be decided within the stipulated time. The petitioner also undertakes to appear in the Court even if the advocates are on strike and will argue the matter. The learned Standing Counsel has no objection to the submission made by the counsel for the petitioner. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Without entering into the controversy involved in the writ petition, the writ petition is disposed of with direction to respondent no. 2 to decide the Case No. 2948 of 2021 (Computerized Case No. T202105470202948) under Section 12 C of UP Panchayat Raj Act, 1947 (Paras Vs. Vinod and others), expeditiously, after hearing the parties concerned, in accordance with law provided there is no other legal impediment.
