Judgment

Court No. - 21 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 2105 of 2023 Petitioner :- Amit Kumar Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Sheetal Prasad Chakravorty Counsel for Respondent :- C.S.C.,Achal Singh Hon'ble Manoj Kumar Gupta,Acting Chief Justice Hon'ble Donadi Ramesh,J.

¶1Present petition has been filed purportedly in public interest seeking a direction to the respondents to take appropriate action in relation to irregularities and illegalities committed by village pradhan in execution of developmental schemes under MGNREGA after constituting an enquiry committee.

¶2It appears from the record that on basis of complaint of the petitioner and some other persons, an enquiry was got conducted through Assistant Development Officer and Additional Programme Officer and they found no substance in the complaint. The report states that the complaints appear to be motivated and malafide. In the writ petition, the petitioner has not disclosed his complete antecedents and has only claimed himself to be a public spirited person.

¶3In the face of findings returned in the enquiry report, we are not satisfied with the bonafides of the petitioner. We therefore decline to examine the dispute at the behest of the petitioner.

¶4The writ petition is accordingly, dismissed.

¶5The impleadment application also stands disposed of. (Donadi Ramesh, J.) (Manoj Kumar Gupta, ACJ.) Order Date :- 2.12.2023/Noman High Court of Judicature at Allahabad
