Judgment

Court No. - 82 Case :- MATTERS UNDER ARTICLE 227 No. - 10061 of 2023 Petitioner :- Smt. Anu Mavi Respondent :- State Of U.P. And 8 Others Counsel for Petitioner :- Gyanendra Kumar Singh Counsel for Respondent :- G.A. Hon'ble Ms. Nand Prabha Shukla,J. Heard learned counsel for the petitioner and learned A.G.A. for the State. In the instant matter, the petitioner is aggrieved by the order dated 23.01.2023 passed by learned Additional District & Sessions Judge/Special Judge (POCSO Act), Court No.3, Ghaziabad by which the criminal revision preferred by the petitioner against order dated 16.07.2022 has been rejected. The main submission of learned counsel for the petitioner is that there is sufÏcient material against the opposite party Nos. 5 to 9 of taking possession of stridhan and grabbing the household goods of the petitioner but the Trial Court has not summoned them under Sections 406, 506 IPC along with the other co-accused (respondent nos. 2 to 4). After perusal of the averment on the complaint, the statements of petitioner under Section 200 Cr.P.C. and the witnesses under Section 202 Cr.P.C. recorded before the Magistrate, it is apparent that there are no specific allegations against the opposite party nos. 5 to 9. Opposite party nos. 2 to 4 have already been summoned to face the trial. There is no illegality in the impugned order. Accordingly, the Writ Petition is dismissed. Order Date :- 2.12.2023 A.N.
