¶1Heard learned counsel for the petitioner, Sri Ashish Agarwal, learned counsel appearing for Income Tax Department and Sri Devendra Gupta, learned counsel appearing for the Union of India.

¶2The present writ petition has been filed by the petitioner under Article 226 of the Constitution of India being aggrieved against the inaction on the part of the respondent No.3 in not deciding the representation of the petitioner dated 29.4.2023.

¶3Upon hearing the learned counsel for both the parties, we are of the view that the following order may be passed: The respondent No.3, being the Principal Commissioner of Income Tax-I Department, Civil Lines, Kanpur, is directed to decide the representation dated April 29, 2023, after granting an opportunity of hearing to the petitioner, within a period of eight weeks from date. Upon passing a reasoned order, a copy of the same shall be handed over to the petitioner within ten days. The petitioner is directed to assist in the inquiry to be conducted by the Department.
