This instant application under Section 482 Cr.P.C. has been preferred by the applicant being aggrieved by order dated 26.08.2023 passed by the learned Additional/ Special Judge (POCSO Act), Mainpuri. At the outset, Shri S.M. Nazir Abbas Abedi, learned counsel for the applicant submits that on account of some defect in the application, the applicant does not want to press this application, therefore, he may be allowed to withdraw this petition. Learned A.G.A. for the State has no objection to such prayer. In view of the statement made by learned counsel for the applicant at the bar, the instant application is dismissed as withdrawn. It is made clear that this order will not come in the way of moving a fresh application with better particulars before the concerned Court below.
