Judgment

Court No. - 35 Case :- WRIT - A No. - 19510 of 2023 Petitioner :- Dr. Gyan Prakash Singh And 4 Others Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Lavlesh Kumar Shukla Counsel for Respondent :- C.S.C.,Vivek Kumar Rai Hon'ble Vikas Budhwar,J. Instruction filed today is taken on record and marked as appendix-A. Heard Shri Lavlesh Kumar Shukla, learned counsel for the writ petitioners who are five in number as well as Shri Saurabh Trivedi, learned Standing Counsel who appears for the respondent No. 1 and Shri Ravi Prakash, advocate holding brief of Shri Vivek Kumar Rai, learned counsel for the respondent nos. 2 to 5. Though the writ petition has been preferred with multiple reliefs first being for the payment of arrears, honorarium/salary for the month of July, 2023 and onwards, however the writ petitioner has made a statement at bar that now the first relief has become infructuous as the writ petitioner has been paid current salary. However, he confines relief with respect to extending benefits of EPF and on extension of the services. The learned counsel for the University has produced before this Court documents showing the fact that the writ petitioner has been made admissible to the payment of honorarium till September 2023, however so far as the other relief is concerned, the writ petitioner may represent his cause before the third respondent, Registrar, Deen Dayal Upadhyay University, Gorakhpur who shall address to the claim. To such a submission, learned counsel for the petitioner has no objection and he gracefully accepts the same. Considering the submissions of the rival parties as well as stand taken by them, the writ petition is being disposed off without seeking any response from the respondents granting liberty to the writ petitioner to prefer a comprehensive representation along with the self-attested copy of the writ petition before the third respondent, who shall on the receipt of the same, proceed to decide the claim of the petitioner strictly in accordance with law within a period of three weeks from the date of presentation of the certified copy of the order. Needless to point out that the writ petition has been decided without seeking any response from the respondents. Thus, passing of this order may not be construed to an expression that this Court has gone into the merits of the case. With the aforesaid observation, the writ petition is disposed off.
