Court No. - 44 Case :- MATTERS UNDER ARTICLE 227 No. - 12253 of 2023 Petitioner :- Poonam Verma And 2 Others Respondent :- Purushottam Verma Counsel for Petitioner :- Shivarchan Mishra Hon'ble Ashutosh Srivastava,J. Heard Sri Shivarchan Mishra, learned counsel for the petitioners. Considering the nature of the order that is proposed to be passed, the service of notice upon respondent is being dispensed with. The present petition under Article 227 of the Constitution of India has been instituted for a direction to the Principal Judge, Family Court, Kaushambi to decide the Case No. 499 of 2021 (Poonam Verma versus Purushottam Verma) under Section 19 of Adoption and Maintenance Act, P.S. Kokhraj, District Kaushambi stated to be pending since 30.11.2021. Learned counsel for the petitioners submits that petitioner no.1 is a young widow, aged about 28 years, whose husband, late Awadhesh Kumar Verma, has expired in an accident leaving behind two children, one female daughter and a male child, who have been arrayed as petitioner nos.2 and 3 to the present petition. The respondent herein is the father-in-law of the petitioner no.1. Proceeding under Section 19 of the Hindu Adoption and Maintenance Act have been instituted seeking maintenance for self and her children, which proceedings are stated to be pending. It is submitted that the respondent has already put in appearance and filed his written statement to the proceedings. He further submits that there is no other means of maintenance available to the petitioners and the prayer for expeditious disposal of the proceedings may be granted. I have heard the learned counsel for the petitioners and perused the record. From the perusal of the order sheet that has been brought on record, it is apparent that the opposite party has already put in appearance and filed his written statement. Considering the fact that petitioner no.1 is a young widow, who has to look after her two young children and she has no source of income otherwise also considering the fact that the respondent being the father-in-law is under an obligation to maintain his daughter-in-law and her children, this Court is of the opinion that ends of justice would stand served if the proceedings are expedited. Accordingly, considering the totality of the circumstance, the petition is disposed of by requiring the Principal Judge, Family Court, Kaushambi, seized with the Case No. 499 of 2021 (Poonam Verma versus Purushottam Verma) under Section 19 of the Hindu Adoption and Maintenance Act to conclude and decide the same within a period of six months from the date of service of certified copy of the order of this Court, in accordance with law without granting unnecessary adjournment to either of the parties.
