Court No. - 32 Case :- WRIT - A No. - 19170 of 2023 Petitioner :- Alok Pratap Singh And 10 Others Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Saurabh Yadav,Naveen Kumar Yadav Counsel for Respondent :- C.S.C. Hon'ble Salil Kumar Rai,J. Hon'ble Mohd. Azhar Husain Idrisi,J. Heard the counsel for the petitioners. The grievance of the petitioners in the present petition is that they are not being permitted to station their buses at Gorakhpur Railway Station. The petitioners claim that they have been granted permits to ply their buses from Gorakhpur Railway Station to Maghar via Nausarh. In pursuance to the previous order passed by this Court, the Standing Counsel has obtained instructions in the matter and has handed over a copy of the same to the Court which is taken on record. On the basis of his instructions, the Standing Counsel states that the petitioners are being restrained from haulting their buses at Gorakhpur Railway Station to maintain law and order under Section 117 of the Motor Vehicles Act, 1988. The instructions do not state that there is any official order by any competent authority restraining the private bus owners to hault their vehicles at Railway Station for which permission has been granted to the petitioners. The petitioners have filed their representation dated 12.10.2023 before the District Magistrate, Gorakhpur in which they state that the police officers of the District Gorakhpur are illegally restraining the petitioners from haulting their vehicles at Gorakhpur Railway Station. The petitioners may file their representation before the Superintendent of Police, Gorakhpur who shall decide the same and take appropriate action in accordance with law depending on his decision within a period of two months from the date of filing their representation. With the aforesaid direction, the writ petition is disposed of. Order Date :- 4.12.2023 Satyam High Court of Judicature at Allahabad
