¶1The instant petition has been filed in public interest seeking a direction to the respondents to issue notification under Section 4A

(2) of the U.P. Consolidation of Holdings Act, 1953 for start of fresh consolidation operation in Village Barabandh, Post Ratsar, Block Gadwar, Tehsil Sadar, District Ballia.

¶2Learned counsel for the petitioner has pointed out that District Consolidation Officer / District Magistrate, has already made recommendation in this regard to the Consolidation Commissioner, U.P. Lucknow, in 2014 but no action has been taken in the matter so far.

¶3Sri Rajiv Gupta, learned Additional Chief Standing Counsel for the State-respondents submits that the Consolidation Commissioner, U.P. Lucknow (respondent no.2) is competent to examine the issue.

¶4Accordingly, the instant petition is disposed of with liberty to the petitioner to approach the Consolidation Commissioner, U.P. Lucknow (respondent no.2) with true copy of the instant order and copy of the recommendation made by District Consolidation Officer / District Magistrate in 2014 so that further action is taken by him in the matter in accordance with law.
