Judgment

Court No. - 5 Case :- WRIT - C No. - 39720 of 2023 Petitioner :- Rakesh Kumar Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Arvind Singh Counsel for Respondent :- C.S.C.,Habib Ahmad Hon'ble Piyush Agrawal,J. Heard learned counsel for the petitioner, Shri Habib Ahmad, learned counsel for the respondent no.3 and learned Standing Counsel for State-respondents. At the very outset, learned counsel for the Bank-respondent no.3 submits that the petitioner has already approached this Court by way of filing Writ-C No.12193 of 2014 (Rajesh Kumar Vs. State of U.P. and two others), which was disposed off on 26.02.2014 and the installments were fixed for paying the recovery amount. He, on the instructions received by the bank, submits that the earlier protection granted to the petitioner has not adhered to. This is a second round of litigation, which is also not maintainable. Confronted with the said fact, learned counsel for the petitioner comes up with a prayer to withdraw the present petitioner at this stage. In view of the above, the writ petition is dismissed as withdrawn at this stage. Order Date :- 4.12.2023 Pravesh Mishra High Court of Judicature at Allahabad
