Learned Standing Counsel raises a preliminary objection regarding maintainability of the writ petition and states that the prayer has been sought seeking mandamus against the private respondent, which is not maintainable. Confronted with the said submission, learned counsel for the petitioners comes up with a prayer to withdraw the present petition with liberty to file a better petition.
