Dwivedi, learned counsel for the respondent raises a preliminary objection with regard to maintainability of the writ petition on the ground that the petitioner had approached Lucknow Bench of this Court by way of Writ C No. 9323/2023, which was dismissed as withdrawn with liberty to move an appropriate application for further directions and for modification of the order of this Court dated 18.10.2022 passed in Writ C No. 23642/2022, but instead of moving appropriate application, the petitioner has filed the present writ petition, which is not permissible. Confronted with the said fact, learned counsel for the petitioner comes up with a prayer to withdraw the writ petition as not pressed.
