Order on Writ Petition The petition has been filed with the prayer to direct respondent nos.2, 3 and 4 to conclude the fair and lawfull inquiry of the Gram Pradhan, Gram Panchayat Khawal, Post Rajaghari, Vikash Khand Mant, District-Mathura and take appropriate decision as early as possible and further direct respondents not to disturb in the peaceful functioning of the Gram Pradhan. Raising objection on the withdrawal application, learned Standing Counsel as well as learned counsel for the complainant submits that earlier Writ – C No. – 39566 of 2023 (Smt. Patari vs. State of U.P. And 4 Others) has been filed and the same has been withdrawn on 02.12.2023 with the liberty to file a better petition. The same request is being made in the present petition, thus the petitioner is not interested in pressing the same. Perusal of record goes to show that the petitioner was elected as Gram Pradhan of Gram Panchayat Khawal, Post-Rajaghari, Vikas Khand-Mant, District-Mathura. On some complaint, an inquiry was conducted by respondent nos.3 and 4 as directed by District Magistrate by order dated 26.05.2023. The preliminary inquiry has not been concluded till date, therefore, a direction may be issued to the concerned respondents to conclude the inquiry. On the basis of instructions, learned Standing Counsel submits that the preliminary inquiry has already been concluded and the financial and administrative powers of the Pradhan has been ceased, therefore, the relief as prayed cannot be granted to the petitioner. However, in the interest of justice, as the petitioner does not want to press the petition, the same is dismissed as withdrawn. The application has been filed by the petitioner with a prayer to permit the petitioner to withdraw the present writ petition and pass appropriate orders accordingly. Learned counsel for the petitioner has moved a withdrawal application, wherein in paragraph no.3 it has been stated that the petitioner does not want to press the present petition. The withdrawal application is allowed.
