¶1Heard learned counsel for the petitioner and perused the record.

¶2Learned counsel for the petitioner confined only with prayer no.2 and submits that learned Principal Judge, Family Court, Gorakhpur is directed to decide the application 24 Ga/1 dated

21.04.2023 (Annexure-5 to the petition) on the next date fixed i.e.

04.12.2023 or prior to 31.12.2023.

¶3So far as prayer no. 1 is concerned court below is directed to decide the Petition No. 54 of 2022 ( Jivendra Singh Versus Vandana Singh), under Section 12 (1) (c) of the Hindu Marriage Act, 1955 within a stipulated time period.

¶4It is argued by the learned counsel or the petitioner that today is the date fixed in the court below.

¶5The matter is pending before the Court below since 2023 and considerable time has already been lapsed but till date no final decision has been taken in the matter.

¶6In the facts and circumstances of the case, the present petition is disposed of directing the court below before whom case is pending to decide the aforesaid case/suit expeditiously in accordance with law, if possible before the date fixed in the matter and without granting unnecessary adjournment unless there is no legal impediment.
