¶1Heard Sri Jitendra Pal Singh, learned counsel for the petitioner, Sri Pawan Kumar Singh, Advocate holding brief of Sri Krishna Kant Singh, learned counsel for the respondent, and learned Standing Counsel and perused the record.

¶2The present petition has been filed with the following prayer: "(i) issue a writ, order or direction in the nature of mandamus certiorari quashing the impugned orders dated 23.08.2023 and 05.07.2022 passed by the respondent no. 2 and 3 respectively.

(ii) issue a writ, order or direction in the nature of certiorari quashing the entire proceeding of case No. 117 of 2017 (Bhanwar Pal Singh Vs. Smt. Sharda Devi) initiated by respondent no. 3 against the petitioner under Section 128 of U.P. Revenue Code, 2006."

¶3Learned counsel for the petitioner has contended that an order dated 05.07.2022 has been challenged by the petitioner by which notices were issued to the opposite parties. Revision filed against the said order has been dismissed.

¶4Since the proceedings under Section 128 under U.P. Revenue Code, 2006 are pending, no illegality has been committed by the court below, hence, I am not inclined to entertain the instant petition.
